Please read these terms and conditions carefully before using our site Web and our mobile application services at www.marise.ca which are operated by MARISE, a women's clothing retailer.

By accessing or using any of our web services, you agree to be bound by these terms. If you disagree with any part of the terms, you may not access our Services.

1. Purchasing

If you wish to purchase any product or service made available through our Web Services, you may be asked to supply certain information relevant to your purchase including, but not limited to, your name, address, email, credit card information, etc.

Our web services allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos or other material. You are responsible for the content, quality and accuracy of the information you share with our web services.

Copyright and other relevant intellectual property rights exist on all text, graphics, illustrations, MARISE logo relating to the Company's services and on the entire content of the Website.

We own and retain all proprietary rights in the Website, the Content and all associated intellectual property rights. You are authorized to use the Website only as authorized by us. As a User, you are granted a limited, non-exclusive, revocable, non-transferable right to use the Website and its Services to create, display, use, read and download content subject to these Terms. Our intellectual property may not be used in connection with any product or service that is not affiliated with us or in any manner that discredits us.

You must not modify physical or digital copies of any content that you print off or download in any way, and you must not use any illustrations, photographs, video or audio, or any graphics separately from any accompanying text.

5. Limitation of liability and warranty

EXCEPT AS OTHERWISE PROVIDED IN THE TERMS AND CONDITIONS OF SALE WHICH GOVERN THE SAME OF EACH PRODUCT ON THIS SITE, THIS SITE, THE PRODUCTS OFFERED FOR SALE ON AND THE TRANSACTIONS COMPLETED ARE PROVIDED BY MARISE “AS IS”. MARISE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE WEBSITE OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED ON THE WEBSITE, EXCEPT AS PROVIDED HEREIN TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS. MARISE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, ACCURACY DATA AND SYSTEM INTEGRATION. ON THE WEBSITE MAY APPEAR INACCURACIES, MISTAKES OR TYPOGRAPHICAL ERRORS THEREFORE MARISE DOES NOT WARRANT THAT THE CONTENT WILL BE UNINTERRUPTED OR ERROR-FREE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARISE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE WEBSITE, INCLUDING, BUT NOT LIMITED TO, INDIRECTLY INCIDENTAL, PUNITIVE, EXEMPLARY DAMAGES , SPECIAL OR CONSEQUENTIAL. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARISE'S TOTAL LIABILITY TO YOU FOR ANY DAMAGES (REGARDLESS OF ACTION) SHALL NOT EXCEED IN THE AGGREGATE THE NUMBER OF FEES ACTUALLY PAID BY YOU TO MARISE DURING THE PREVIOUS MONTH IMMEDIATELY THE ACT GIVING RISE TO MARISE’S RESPONSIBILITY.

6. Acceptance of the order

Please note that there may be some orders that we will not accept and will have to cancel. MARISE reserves the right, in its sole discretion, to refuse or cancel any order for any reason. Certain situations may result in the cancellation of your order, including quantity limitations available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud department. We may also require additional verifications or information before accepting any order. We will contact you if all or part of your order is canceled or if additional information is required to accept your order.

Both parties agree that after the order is shipped, the third-party logistics company is solely responsible for transportation. During this process, full ownership of the product(s) remains with the buyer; all responsibilities and risks associated during transportation are the buyer's responsibility.

7. Transfer of ownership

Title to the products in your order will pass to you when the products leave our warehouse and are released to the carrier for shipment to an address you specified in the order. All responsibility and risk for the Products will also pass to you at that time. By placing an order on the Website, you authorize MARISE to engage third party shipping services on your behalf.

8. Typographical errors

Although MARISE strives to provide accurate product and pricing information, pricing or typographical errors may still occur. MARISE can only confirm the price of an item after ordering. In the event an item is listed at an incorrect price or with incorrect information due to pricing error or product information, MARISE shall have the right, in our sole discretion, to refuse or cancel any orders placed for the item. If an item is mispriced, MARISE may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation.

9. Compensation

YOU HEREBY INDEMNIFY AND AGREE TO HOLD MARISE INDEMNIFIED AGAINST ALL LOSSES, DAMAGES, COSTS, LIABILITIES AND EXPENSES (INCLUDING BUT NOT LIMITED TO LEGAL FEES AND ANY AMOUNTS PAID BY MARISE TO A THIRD PARTY IN THE SETTLEMENT OF A CLAIM OR DISPUTE ON THE ADVICE OF LEGAL ADVISORS OF MARISE) INCURRED OR SUFFERED BY MARISE ARISING OUT OF ANY BREACH BY YOU OF ANY PROVISION OF THESE TERMS AND CONDITIONS, OR ARISING FROM ANY CLAIM THAT YOU HAVE VIOLATED ANY PROVISION OF THESE TERMS AND CONDITIONS.

10. Force Majeure

Neither party will be liable to the other for any failure to perform any obligation under any agreement caused by any event beyond that party's control, including, but not limited to, any force majeure, terrorism , war, political insurrection, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made contingency beyond our control, which results in the termination of an agreement or of a concluded contract, or by an event beyond the control of such party which could not be reasonably foreseen. Any party affected by any such event will immediately notify the other party and will use all reasonable efforts to comply with the terms and conditions of any agreement contained herein.

11. Termination

You agree that we may, at any time and in our sole discretion, with or without cause or notice, terminate your access to the Website. We will not be liable to you or any third party for any claims or damages arising from any termination or suspension or any other action taken by us in connection therewith. If applicable law requires us to provide notice of termination or cancellation, we may give prior or subsequent notice by posting it on the Website or sending a communication to any address (e-mail or otherwise) we have for you in our files.

12. Notice of changes

The Company reserves the right to modify these terms from time to time as it sees fit and your continued use of the Website constitutes your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and other key pages throughout the website. If there are any changes in the way we use personally identifiable information about website customers, notification by email or postal mail will be made to those affected by the change. Any changes to our Privacy Policy will be posted on the Website 30 days before such changes take place. You are therefore advised to reread this declaration regularly.

These general conditions are governed by Canadian laws.

13. Payment method

MARISE will accept Master Card, Visa and American Express as payment methods for purchases made through our secure website. The person placing the order must always be the cardholder.

14. Secure Transactions

MARISE always uses secure connections for all processed transactions. Credit card information is securely transmitted directly to our certified "payment gateway processor" and is not retained in any way in our databases for your own security.

15. Confidentiality

We are committed to preserving your privacy. We will only collect and process your data in compliance with the law, including legal obligations, e.g. fraud, money laundering prevention.

Only qualified Marise employees will have access to it. Where we use third party data processors to assist us, those third parties will only use your data for the purposes described in this privacy policy. We reserve the right to revise this privacy policy from time to time.
